Summary

Attitudes expressed by the Jingan getihu about official norms of socialist legalism suggest that the regime may be unable to control the norms and ideologies of market actors. Respondent views about equality imposed a higher standard of substantive equality than is evident in the regime’s formalistic doctrine. Similarly, support for justice as procedural fairness may hold official norms of formal justice to a more rigorous standard. As well, doubts emerged as to the prospects of realizing the ideals of equality and justice in practice. And while there was nascent support for formal dispute resolution, the general preferences for informal mechanisms serve as a counterpoint to regime norms requiring continued state control over the judiciary.

The responses of the Jingan getihu to regime doctrines of legal reform suggest the emergence of an “alienated legal culture” which stands in tension with the norms and institutions of the socialist legal system. Rather than uncritically subscribing to ideals and practices that are intended to perpetuate the state’s hegemony, the respondents to this survey stand apart, cautiously using what is made available to them for their own purposes but not fully subscribing to the underlying norms or institutional arrangements. This finding has important implications for the efficacy of the regime’s norms and institutions in preserving its hegemonic position, for the state is challenged by these private imaginings of ideals for social and economic relations that go well beyond the suggestions of formalized doctrines.
